Welcome to ByteAiBoost. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", "Client") and ByteAiBoost ("Company", "we", "our", or "us").

By accessing our website, purchasing our services, creating an account or using any of our applications, you agree to comply with these Terms and all applicable laws and regulations.

If you do not agree with these Terms, you must discontinue the use of our website and services immediately.

Your continued use of ByteAiBoost indicates your acceptance of these Terms, our Privacy Policy and any additional policies that may apply to specific products or services.

Some ByteAiBoost services require an account. You agree to provide accurate, complete and current information during registration.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate accounts containing inaccurate information, fraudulent activity or violations of these Terms.

You agree to use ByteAiBoost's services responsibly, lawfully and in accordance with these Terms and all applicable laws.

You are solely responsible for all content, data, campaigns, customer communications and business information submitted or processed through our platform.

Certain ByteAiBoost products and services require payment. Pricing, subscription fees and applicable taxes will be displayed before purchase.

By purchasing our services, you authorize us or our payment providers to charge the applicable fees using your selected payment method.

Failure to make timely payments may result in suspension or termination of your access to paid services.

Certain services are offered as monthly or annual subscriptions. Subscription plans may include usage limits, messaging quotas, AI credits or feature restrictions depending on the selected plan.

You may upgrade or downgrade your subscription where supported. Changes may become effective immediately or at the start of the next billing cycle.

We reserve the right to modify pricing or subscription features with reasonable prior notice.

Unless otherwise stated in a written agreement, payments made for digital services, SaaS subscriptions, consulting, implementation, software development and AI services are generally non-refundable.

Refunds, if approved, will be processed using the original payment method within a reasonable period.

Service interruptions caused by third-party providers, including Meta, WhatsApp, Google or hosting providers, do not automatically qualify for refunds.

All software, source code, designs, branding, trademarks, graphics, user interfaces, AI workflows, documentation and platform functionality remain the exclusive property of ByteAiBoost unless otherwise agreed in writing.

Purchasing our services does not transfer ownership of our intellectual property. You receive only the rights expressly granted under these Terms.

Our platform integrates with third-party services including Meta, WhatsApp Business Platform, Google, cloud hosting providers, payment gateways, analytics services and other technology providers.

Your use of these third-party services is subject to their respective terms, privacy policies and operational requirements. ByteAiBoost is not responsible for the availability, policies or actions of third-party providers.

ByteAiBoost provides integrations with the WhatsApp Business Platform and WhatsApp Cloud API. By using these services, you acknowledge that your use is also subject to Meta's applicable terms, policies and developer requirements.

You are responsible for obtaining all necessary customer consents before sending messages through WhatsApp and for ensuring that your communications comply with applicable laws and regulations.

ByteAiBoost does not control Meta's services and is not responsible for message delivery failures, account restrictions, policy violations, template rejections or service interruptions caused by Meta or WhatsApp.

Our platform may use artificial intelligence to generate content, automate workflows, summarize conversations, suggest responses and assist business operations.

AI-generated responses are produced automatically and may not always be accurate, complete or suitable for every situation. You should independently review important outputs before relying on them for legal, financial, medical or other critical decisions.

You remain solely responsible for all content published or shared using AI-generated suggestions.

We strive to provide reliable and uninterrupted services. However, we do not guarantee that our platform will always be available without interruption, delay or error.

Scheduled maintenance, infrastructure upgrades, third-party outages, internet failures and events beyond our reasonable control may temporarily affect service availability.

We reserve the right to modify, suspend or discontinue any service or feature at any time with reasonable notice where practicable.

To the maximum extent permitted by applicable law, ByteAiBoost, its directors, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from your use of our services.

This includes, without limitation, loss of profits, loss of business opportunities, loss of goodwill, data loss, business interruption or damages resulting from third-party platform failures.

Our total liability for any claim relating to our services shall not exceed the amount actually paid by you for the specific service giving rise to the claim during the preceding twelve months, unless otherwise required by applicable law.

You agree to defend, indemnify and hold harmless ByteAiBoost, its officers, employees, affiliates and partners from any claims, liabilities, damages, losses or expenses arising out of your use of our services, violation of these Terms or infringement of any third-party rights.

This obligation includes reasonable legal fees and costs incurred in defending such claims.

All ByteAiBoost services are provided on an "as is" and "as available" basis unless expressly stated otherwise in a written agreement.

We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, uninterrupted operation or error-free performance.

We do not guarantee any specific business results, marketing performance, search rankings, advertising outcomes, lead generation or revenue growth through the use of our services.

We reserve the right to suspend, restrict or terminate your access to our services if you violate these Terms, engage in unlawful activities, misuse the platform or create security or operational risks.

Upon termination, your right to access the affected services will immediately cease. Certain obligations, including payment obligations, intellectual property rights, confidentiality, limitation of liability and indemnification, will survive termination.

You may discontinue using our services at any time, subject to any applicable subscription or contractual commitments.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, controversy or claim arising out of or relating to these Terms or your use of ByteAiBoost's services shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India, unless otherwise required by applicable law.

We may update these Terms & Conditions from time to time to reflect changes in our services, technology, legal obligations or business operations.

Updated versions will be published on this page together with the revised "Last Updated" date. Continued use of our platform after such updates constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms & Conditions, together with our Privacy Policy, Cookie Policy and any additional written agreements, constitute the entire agreement between you and ByteAiBoost regarding your use of our services.
